The article is focused on the assessment of damage caused to the owner of the wheeled transport vehicle as a result of the wrongful acts, transport accidents etc. It is established that the “Methodology for merchandising expertise and assessment of transport vehicles” that is used for price evaluation, is not adjusted to the current economic situation in the country that results in the wrongful determination of the harm incurred. The difference between the economic categories “costs” and “substantial losses” is defined with application of methods of economic analysis and synthesis; the necessity of specification of certain regulations of methodology is substantiated. The comparative analysis of economic categories ‘damage’, ‘material harm’, ‘cost of the material harm’ is carried. The methodology of assessment of material harm is considered, it is based on the costs approach, method of calculation of repair, determination of the market price of the wheeled transport vehicle for the time of the accident. Based on the method of analysis of the constituents of the market price, it is established that such a ‘combined cost’ is not eh market price, but the residual cost or the average cost. It is defied that the methodology for assessment of material damage does not consider the costs of transportation, storage, expertise costs, postal costs, and other expenses such as technical expertise fees etc. The authors outline the problem of gap between the market price of the same wheeled transport vehicle assessed by a valuer and the court expert; such problem arises due to the discrepancies between the methodological principles of the assessment. The issue of discrepancies within the assessment of costs and damages is topical and scientifically novel. The results of the research can be practically applied for substantiation of the discrepancies that arise in case of hearing of the case with the claim for damages that is based on the results of the resolution of the court expert or the court expertise and which is adversely to the valuer`s assessment is admissible without official review. Much attention is given to the elimination of discrepancies of the qualification requirements for the assessment of costs and losses of the owner of the wheeled transport vehicle and the training programmes for the court experts.
